The General Department of Taxation has just submitted a written request to the Tax Departments of the provinces and cities directly under the Central Government to implement the extension of tax payment and exemption of late payment interest for taxpayers affected by Covid-19 epidemic.
On March 10, the Ministry of Finance said that the General Department of Taxation had sent a written request to the Tax Departments of the provinces and centrally-run cities to implement the extension of tax payment and exemption of late payment interest for taxpayers affected by Covid-19.
In the document sent to localities, the General Department of Taxation stated that due to the impact of the epidemic, many businesses (businesses) suffered great losses, had difficulty in producing and consuming goods and services, and were unable to pay taxes on time. According to the General Department of Taxation, cases of tax payment extension must be considered according to the provisions of Circular No. 156 of the Ministry of Finance.
Specifically, these are cases of physical damage that directly affect production and business due to natural disasters, fires, unexpected accidents. Cases considered as unexpected accidents include: traffic accidents; labor accidents; suffering from dangerous diseases; epidemic diseases at the time and in areas where competent agencies have announced there are contagious epidemics; other force majeure circumstances. "
To enjoy tax payment extension according to the above provisions, the taxpayer must make and send the tax request extension to the tax authorities directly managing the taxpayer. A dossier comprises Written request for extension of tax payment by taxpayers; minutes of inventory and assessment of material damage written by the taxpayer or the legal representative of the taxpayer; written certification of the damage caused by taxpayers at the place of a natural disaster, fire or unexpected accident and the time of occurrence of a natural disaster, fire or unexpected accident of one of the following agencies or organizations: Police Office; People's Committees of communes and wards; management boards of industrial parks, export processing zones, economic zones where natural disasters, fires, unexpected accidents occur or organize rescue.
Regarding the authority to extend the tax payment time limit, the General Department of Taxation says that the head of the tax agency directly managing the taxpayer decides the extended tax amount and the duration for a tax payment extension.
Regarding the exemption of late payment interest, pursuant to Circular 156, the General Department of Taxation states that taxpayers have the right to request exemption of late payment interest in the case of natural disasters, fires, unexpected accidents, epidemics or dangerous diseases, or other force majeure circumstances. The exemption of late payment interest is also considered with all required documents.
